Agreement and website use
By submitting a request or completing checkout, you agree to these Terms, the Privacy Policy, and the Order Policies. If you do not agree, do not submit information or payment through the website. You may contact Lucky Plants by phone for an alternative.
You must provide accurate information and use the site only for lawful purposes. Do not interfere with the site, attempt unauthorized access, submit harmful code, misuse payment systems, or upload illegal, deceptive, or infringing material.
Plant order requests
The custom order form saves your plant list and contact details but does not charge you. An order request does not reserve inventory or create a completed sale. Lucky Plants will contact you to confirm the exact plant, size, quantity, substitutions, price, tax, fees, fulfillment, and timing before payment for plants is due.
$75 Plant Planning Service
The plant-plan form collects project information and private room photos, then sends you to secure checkout for the one-time $75 Plant Planning Fee. The fee pays for Lucky Plants to review the submitted space and prepare personalized plant recommendations. A purchase is complete only after the payment provider confirms successful payment.
If payment fails, is canceled, or remains incomplete, Lucky Plants is not required to begin the plan. Do not submit a second payment if your bank shows a charge. Contact us so we can check the first transaction.
Qualifying plant-purchase adjustment
If the same customer purchases at least $300 in eligible live plants directly from Lucky Plants within 30 calendar days after receiving the recommendations, Lucky Plants will apply $75 once to that plant merchandise subtotal. The $300 minimum is calculated before the $75 adjustment and before taxes, delivery, placement, installation, maintenance, pots, containers, and other products or service fees.
The adjustment is a limited benefit of the paid planning service. It is not a deposit, gift card, stored-value balance, refund, or general store credit. It is nontransferable, has no cash value, cannot be combined with another planning-fee adjustment on the same purchase, and cannot be used on an order with less than $300 in eligible plants. Any unused or expired amount is forfeited. Tell Lucky Plants the confirmation number before the qualifying purchase is finalized.
Cancellation and refunds
The $75 Plant Planning Fee is nonrefundable because it reserves time for reviewing the submitted information and preparing recommendations. A decision not to buy plants, a plant purchase below the $300 minimum, or failure to make a qualifying purchase within 30 days does not create a refund, cash balance, or replacement credit.
If Lucky Plants cannot provide the purchased planning service, Lucky Plants will refund the planning fee. Refund timing depends on the payment provider and your financial institution. These terms do not limit any refund or consumer right that cannot legally be waived.
Photos and submitted content
You keep ownership of the photographs and project information you submit. You give Lucky Plants permission to store, review, reproduce internally, and share them with service providers only as reasonably needed to prepare and deliver the requested service, operate the website, process payment, or resolve a concern.
You confirm that you have permission to submit the content and that it does not violate another person’s privacy, copyright, or other rights. Lucky Plants will not use room photos publicly or for marketing without separate permission.
Recommendations and living products
Recommendations depend on the information and photographs you provide. Plants are living products, so appearance, size, color, growth, availability, and response to a space vary. Care and toxicity information is general guidance, not veterinary, medical, architectural, or professional safety advice.
Pricing, payment, and third-party services
Except for the stated plant-plan fee, displayed prices and examples are informational until Lucky Plants confirms them. Card checkout, email delivery, hosting, storage, maps, and other features may be operated by third parties with separate terms. Lucky Plants does not store full payment-card credentials and is not responsible for a third-party system outside our reasonable control.
Disclaimers and responsibility
We work to keep site information accurate and the website available, but we do not promise uninterrupted access or that every item shown is available. To the extent permitted by law, Lucky Plants is not responsible for indirect or consequential loss arising from website use, a delayed third-party service, or conditions that were not accurately disclosed.
Nothing in these terms limits rights or remedies that cannot legally be waived, including applicable California consumer protections.
California law and changes
These terms are governed by California law. We may update them when the website, services, pricing, or legal obligations change. The terms shown when you submit a request or complete checkout apply to that transaction.
